Indiana imposes a controlled substance excise tax on anyone caught with drugs in their possession, delivering drugs, or manufacturing drugs. The amount of this excise tax is determined by the weight or count of the substance. The count will be applied to the amount of substance when it is seized regardless of the form: dosage, pill, capsule, hit, or rock. The gram weight of drugs seized will be measured whether it is pure, impure, or diluted. A diluted substance is a controlled substance that has been thinned but still has a detectable quantity of the pure controlled material and any excipient, fillers, or waste. An excipient is an inactive compound used as a carrier or additive for the controlled substance.
The amount of excise tax applied to confiscated controlled substance is:
- Forty dollars for each gram of a schedule I, II, or III controlled substance, except marijuana.
- Forty dollars for each dosage, pill, capsule, hit, or rock of a schedule I, II, or III controlled substance.
- Three dollars and fifty cents for each gram of marijuana.
- Twenty dollars for each gram of a schedule IV controlled substance.
- Twenty dollars for each dosage, pill, capsule, hit, or rock of a schedule IV controlled substance.
- Ten dollars for each gram of a schedule V controlled substance.
- Ten dollars for each dosage, pill, capsule, hit, or rock of a schedule V controlled substance.
According to the U.S. Drug Enforcement Administration (DEA), drugs are scheduled as follows:
- Schedule I Drugs – GHB, Cannabis, Heroin, Ecstasy, Psychedelic Mushrooms, Foxy, LSD, Peyote, Mescaline, Quaalude, STP, THG, Blue Mystic, Nexus, Ketoamphetamine, etc.
- Schedule II Drugs – Cocaine, Methamphetamine, Ritalin, Opium, Methadone, Percocet, OxyContin, Percodan, Morphine, PCP, Amphetamines, Demerol, Nembutal, etc.
- Schedule III Drugs - Anabolic Steroids, Ketamine, Marinol, Xyrem, Vicodin, Tylenol 3, Codeine, LSA, Pentobarbital, Talbutal, Hydrocodone, Oxymorphone, Dihydrocodeine, Dilaudid, etc.
- Schedule IV Drugs - Xanax, Librium, Valium, Restoril, Temazepam, Ambien, Rohypnol, Doloxene, Darvocet, Miltown, Talwin, Aquachloral, Phenobarbital, Pemoline, Modafinil, etc.
- Schedule V Drugs – Lyrica, Pyrovalerone, Lomotil, Motofen, cough suppressants containing small amounts of Codeine, medicines containing small amounts of Opium or Diphenoxylate.
