According to Indiana code, any person who knowingly or intentionally touches another person in an insolent, rude, or angry way commits battery and will be charged with a Class B misdemeanor.

The offence is elevated to a Class A misdemeanor if:

  • The action results in bodily injury to any other person.
  • The action is committed against a law enforcement officer or a person that has been instructed by an officer performing their official duty.
  • The action is committed against a penal facility or juvenile detention facility employee while performing their official duty.
  • The action is committed against a firefighter while performing their official duty.
  • The action is committed against a community policing volunteer while performing their duties or because the person is a policing volunteer.

The offence is elevated to a Class D felony if it results in bodily injury to:

  • A law enforcement officer or a person instructed by an officer while performing their official duty.
  • A person under fourteen years of age and is committed by a person eighteen years of age or older.
  • Anyone of any age who has mental or physical disabilities and is committed by the person legally or voluntarily responsible for the care of that person.
  • The victim if that person was previously attacked by the same person and the offender was convicted of battery for the previous offense.
  • An endangered adult.*
  • An employee of the department of correction while performing their official duty.
  • An employee of a school while performing their official duty.
  • A correctional professional while performing their official duty.
  • A health care provider while performing their official duty.
  • A penal facility or juvenile detention facility employee while performing their official duty.
  • A firefighter while performing their official duty.
  • A community policing volunteer while performing their duties or because the person is a policing volunteer.

The offence is elevated to a Class C felony if it results in serious bodily injury to:

  • Any other person or if it is committed with the use of a deadly weapon.
  • An endangered adult.*

The offence is elevated to a Class B felony if it results in:

  • Serious bodily injury to a person under fourteen years of age and is committed by a person eighteen years of age or older.
  • Death of an endangered adult.*

The offence is elevated to a Class A felony if it results in death to:

  • A person under fourteen years of age and is committed by a person eighteen years of age or older.
