According to Indiana law, a person commits robbery when a person knowingly or intentionally takes property from another person or from the presence of another person by:
- Using force or threatening to use of force on any person.
- Putting any person in fear.
This action constitutes a charge of a Class C felony. The action becomes a Class B felony if it is committed while armed with a deadly weapon or if the action results in injury to any person other than a defendant. The charge becomes a Class A felony, If the action results in serious bodily injury to any person other than the defendant. Also, a person who knowingly or intentionally takes a vehicle from another person or from the presence of another person by using force, threatening with the use of force, or by putting a person in fear commits carjacking. This action is a Class B felony. The intensity of threat or force used in the robbery does not have to be high to meet the minimum statutory requirement.
Prison time by felony:
- Class C Felony: up to eight years in prison.
- Class B Felony: up to 20 years in prison.
- Class A Felony: up to 50 years in prison.
